Origo Collective (Pty) Ltd
Terms and Conditions
Last updated: 26 October 2026
These terms govern your use of this website and the travel arranging services provided by Origo Collective (Pty) Ltd ("Origo", "we", "us", "our"). Please read them carefully. By enquiring with us, confirming a booking, or using this website, you accept these terms on behalf of yourself and everyone in your travelling party.
1. About us
Origo Collective (Pty) Ltd is a company registered in South Africa (registration number 2026/530535/07), with its registered office in Johannesburg, South Africa. You can reach us at explore@withorigo.com or on +1 954 248 8100.
2. Our role
This clause is the most important one to understand, because it defines what we are responsible for.
Origo is a travel arranger. We design journeys, source options, introduce you to suppliers, and guide you through booking. These terms apply to every experience we arrange, whether taken on its own or combined into a package, including:
private yacht charter, for which we act as your retail charter broker, representing you as the charterer;
African safari;
rare wildlife and landscape experiences, such as gorilla trekking, the Great Migration, hot air balloon safaris, the Namibian desert and whale watching;
signature stays, such as safari lodges, bush camps and private island retreats;
island and coastal journeys, such as Zanzibar, the Seychelles, Mauritius and the Mozambique archipelagos;
food, wine and dining experiences; and
any other experience we arrange for you, and any package combining the above.
For every experience other than yacht charter, we act as a facilitator between you and the relevant lodges, camps, ground operators, hosts, guides, airlines and destination specialists. Where a package combines several experiences, each component is still provided by its own Supplier under that Supplier's terms.
We are not a tour operator, and we are not the principal supplier of any travel service. The actual travel services, the yacht and its crew, the lodges, camps, flights, transfers, guides, hosts and activities, are provided by independent third parties ("Suppliers"). Your contract for each travel service is with that Supplier, under the Supplier's own terms and conditions, not with Origo.
For a crewed yacht charter, this means you enter into a charter agreement directly with the vessel's central agent, usually on an industry-standard MYBA Charter Agreement. That agreement, not these terms, governs the charter itself, including payment, the Advance Provisioning Allowance, cancellation and the conduct of the charter.
We select and recommend Suppliers with care, but we do not own, manage or control them, and we are not responsible for their acts or omissions. Clauses 11 and 12 set out the limits of our responsibility.
3. Enquiries, quotes and proposals
Any itinerary, proposal or quote we provide is an indicative recommendation based on information available at the time. It is not a confirmed booking and does not guarantee availability or price. Rates, availability and taxes change, and are only confirmed once the relevant Supplier confirms them in writing and you enter into the Supplier's contract.
Unless we state otherwise, prices are quoted in the currency of the Supplier or the relevant market, often United States Dollars for yacht charter. Where a price is shown in another currency for convenience, the amount payable is governed by the Supplier's contract and may move with exchange rates until payment is complete.
4. Making a booking
A booking is only confirmed when the relevant Supplier issues its confirmation or contract, you have accepted that Supplier's terms, and the required deposit has been paid to the Supplier or its stakeholder or escrow account.
For yacht charter, you sign the central agent's charter agreement and pay the deposit into the stakeholder account named in that agreement. Origo does not issue the charter contract and does not hold your charter funds at any stage.
It is your responsibility to read each Supplier's terms before you commit. If anything in them is unclear, ask us and we will help you understand it, but the Supplier's terms are the ones that bind you for that service.
For some bookings, particularly yacht charter, the Supplier or central agent may require identity documents, proof of address and source-of-funds information for members of the party before a booking can be confirmed, as part of their anti-money-laundering and sanctions checks. A booking is conditional on this being provided when requested. We have no control over these requirements and are not responsible for a booking that cannot proceed because they are not met.
5. Payment
Payment for travel services is made to the Supplier, the central agent, or the stakeholder or escrow account named in the Supplier's contract, in the manner and on the dates that contract sets out. Origo does not receive or hold funds that are due to a Supplier for your travel.
Where Origo charges you a separate planning, facilitation or service fee for its own work, that fee is set out and agreed with you in writing before you commit, and is invoiced by Origo directly. Any such fee is earned for the work of designing and arranging your trip, and once that work has begun it is non-refundable except to the extent we state otherwise in writing.
You are responsible for any bank charges, card fees or currency conversion costs applied by your bank or the payment provider.
6. Prices, taxes and additional costs
The advertised or quoted base price for a travel service is often not the full cost. Depending on the service, the following may apply on top of it, and are payable under the Supplier's contract:
For yacht charter, an Advance Provisioning Allowance (APA), typically 25 to 35 percent of the base fee, which is a refundable float covering fuel, food, dockage, port and park fees and similar running costs, reconciled at the end of the charter with any unspent balance returned to you.
Local charter tax, VAT, port fees or cruising fees, which vary by destination and are calculated on the base fee.
Customary crew gratuity, at your discretion, usually given at the end of the charter.
For safari and land arrangements, items described as excluded in the itinerary, such as certain flights, premium drinks, gratuities, park fees, visas and personal spending.
We will always set out the expected cost structure as clearly as the Supplier allows before you commit, but final figures are confirmed by the Supplier.
7. Changes and cancellations
Changes and cancellations to a confirmed travel service are governed by the Supplier's contract, including the charter agreement for a yacht. Cancellation charges, deadlines for final payment, and any refund depend on that contract and on how much notice is given. Some Supplier terms are strict, and a late cancellation may mean the loss of all monies paid.
All change or cancellation requests must be made in writing. We will help you deal with the Supplier, but we cannot change or waive a Supplier's terms, and we cannot recover money that the Supplier's contract does not provide for.
Any fee charged by Origo for its own services is dealt with separately under clause 5 and does not depend on the Supplier's cancellation outcome.
8. Your responsibilities
You are responsible for:
Valid passports, with the validity and blank pages required by each country on your itinerary. Many African countries require a passport valid for at least six months beyond your return date and two or more blank pages.
Any visas, entry permits or electronic travel authorisations required for your nationality and route, and for confirming these with the relevant authorities. A visa does not guarantee entry.
Any vaccinations or health precautions required or recommended for your destinations, including yellow fever certificates and malaria precautions where relevant. Consult a qualified medical practitioner in good time before travel.
Being physically fit for the activities in your itinerary, and telling us in advance of any medical condition, disability or dietary need so we can check what a Supplier can accommodate.
The accuracy of the names, dates and details you give us. Corrections made after booking may carry Supplier charges.
Your conduct during travel. Suppliers, including a yacht's captain, may refuse or discontinue service for behaviour that is unsafe or unlawful, and no refund is due in that case.
Keeping yourself informed of official government travel advisories for your destinations. If you choose to travel against an official advisory or warning, you do so at your own risk.
9. Travel insurance
Comprehensive travel insurance is a condition of travelling on arrangements we make. You must hold insurance that is adequate for your itinerary and party, taken out at the time of booking, covering at least cancellation and curtailment, medical expenses and emergency evacuation, and appropriate cover for any activities you will undertake, including watersports and remote travel. If you travel without adequate insurance, you do so at your own risk, and Origo is not responsible for any loss you could have insured against.
10. Wildlife, marine activities and inherent risks
Travel of this kind carries inherent risks that are part of the experience and outside anyone's full control. Wildlife sightings, including specific species or events such as the Great Migration or whale sightings, cannot be guaranteed. Safari, boating, watersports and remote-area travel involve natural hazards. You take part in activities at your own risk and must follow the reasonable safety instructions of guides, crew and operators at all times.
11. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our own negligence, for fraud, or for anything that cannot lawfully be limited or excluded.
Subject to that:
We are not liable for the acts or omissions of any Supplier, or for the travel services themselves, which are provided under the Supplier's contract with you.
We are not liable for loss, damage, injury, delay or additional cost caused by a Supplier, by you, by a third party unconnected with the arrangements we make, or by events outside our reasonable control (see clause 12).
We are responsible only for the arranging services we ourselves provide, and only where we have failed to use reasonable care and skill in providing them.
Where we are found liable to you, our total liability is limited to the amount of the fees you have paid to Origo for its own services in connection with the relevant booking. We are not liable for indirect or consequential loss, or for loss of enjoyment where the service you received broadly matched what was booked.
We are not responsible for information published by Suppliers or third parties, including their brochures, websites and representations, which are outside our control.
12. Circumstances beyond control (force majeure)
We are not liable for any failure or delay in our obligations, or for any change to or cancellation of travel arrangements, caused by events beyond our reasonable control. These include natural disasters and extreme weather, fire, flood, epidemic or pandemic, war, terrorism or civil unrest, strikes, government action, border or airspace closures, travel restrictions and the failure of public services. Where such an event affects a confirmed service, the Supplier's contract governs what happens to monies paid.
13. Complaints
If something is not right during your travel, you must raise it with the relevant Supplier, central agent, guide or crew at the time, so it has the chance to be put right then. If it cannot be resolved, tell us as soon as reasonably possible so we can assist. Any complaint you wish to pursue with us must be put in writing within 30 days of the end of your trip. Raising a concern only after you return limits what can be done about it.
14. Intellectual property and non-circumvention
The itineraries, proposals, written material and designs we prepare for you remain the property of Origo. They are provided for your personal use in considering a booking with us, and may not be passed to third parties or used to arrange a similar trip directly or through another agent.
Where we introduce you to a Supplier, you agree not to bypass Origo to book that or a substantially similar arrangement directly with that Supplier, or through another broker or agent, for a period of 12 months after the introduction.
15. Privacy
We handle your personal information in line with our Privacy Policy and the Protection of Personal Information Act, 2013 (POPIA). Please read the Privacy Policy, which forms part of these terms.
16. Website use
The content of this website is provided for general information and inspiration. We take care to keep it accurate, but we do not warrant that it is complete or error-free, and it does not form part of any contract until confirmed in writing. The website and its content, including text, images and branding, are owned by or licensed to Origo and may not be copied or used without our permission.
17. Media and photography
From time to time we, or a Supplier, may take photographs or video during an experience. Where we wish to use images that identify you for our own marketing, we will ask for your consent first, and you may decline, or withdraw consent later, by writing to us.
18. Governing law
These terms, and any dispute arising from them or from our services, are governed by the law of the Republic of South Africa, and are subject to the exclusive jurisdiction of the South African courts. The travel services provided by Suppliers are separately subject to the Supplier's contract and the law that applies to it.
19. Changes to these terms
We may update these terms from time to time. The version in force is the one published on this website at the time you make an enquiry or booking, dated at the top of this page.
